Wrongful Termination: Defined

New York is an at-will employment law state. Employment relationships in Scarsdale and elsewhere in Westchester County are presumed to be voluntary. In most cases, an employer can terminate an employee at any time. That means that a worker can be removed with or without cause. With that being said, there are legal exceptions. An employee in Scarsdale cannot be removed for an “illegal” reason. A wrongful termination occurs when a business or organization fires or otherwise discharges a worker in violation of state or federal law.

Know the Grounds for Wrongful Termination in New York

Wrongful termination cases are complicated. For an employee to bring a successful wrongful termination claim, they must have valid grounds. Here is an overview of the most common grounds for a wrongful termination case in Scarsdale:

  • Discrimination: An employer cannot fire an employee based on protected characteristics such as race, color, national origin, sex, sexual orientation, religion, age, disability, or pregnancy status. A termination motivated by bias may be against Title VII of the Civil Rights Act and/or the New York State Human Rights Law.
  • Retaliation: Workers should be able to exercise their rights without facing any punishment from their employer. It is unlawful for an employer to terminate an employee for engaging in a legally protected activity. Examples include reporting workplace harassment, filing a wage complaint, or acting as a whistleblower.
  • Public Policy Violation: In New York, employers cannot legally terminate employees for reasons that violate established public policy. For example, firing someone for serving on a jury, reporting criminal activity, or refusing to engage in illegal conduct may qualify.
  • Breach of Contract: Finally, an employee could also potentially have a wrongful termination claim on the grounds of breach of contract. Although most employment in New York is at-will, some workers are employed under a contract. If an employer fires or lays off a worker in breach of contract, they may be liable for wrongful termination.

Remedies for Wrongful Termination in Scarsdale

If you were the victim of a wrongful termination in Scarsdale, you have the right to bring an employment law claim. There are a number of potential remedies available. Our New York employment attorneys can review your case and help you determine the best course of action to get justice and compensation. Every case is different. Here is an overview of possible remedies:

  • Reinstatement: You could be returned to your former job. With that being said, reinstatement is less common. Often, neither party wants to resume the relationship.
  • Monetary Compensation: Wrongfully terminated employees seek monetary compensation, including back pay (wages you would have earned), front pay (future lost earnings), and possibly emotional distress damages.
  • Punitive Damages: In cases involving intentional discrimination or retaliation, punitive damages may be available to punish the employer and deter future misconduct. Though, punitive damages are only awarded in a limited number of wrongful termination cases.
